1. Services

Swami Empire provides digital marketing, web and app development, branding, and related services as described on our website or in a signed proposal/service agreement. Specific scope, timelines, and deliverables for any engagement are governed by that proposal or agreement, which takes precedence over general descriptions on this website.

2. Client Responsibilities

• Provide accurate business information, brand assets, and timely feedback required to deliver services
• Ensure any content, trademarks, or materials provided to us for use in campaigns do not infringe third-party rights
• Make payments per the agreed schedule to avoid delays or suspension of services
• Maintain ownership and security of their own ad platform, hosting, and domain accounts where applicable

3. Fees & Payment

Fees are as quoted in your proposal or agreement. Recurring services are billed monthly in advance; project-based services follow the milestone schedule specified in the agreement. Late payments beyond 7 days of the due date may result in pausing of active work until settled. Refund terms are governed by our Refund Policy.

4. Intellectual Property

• Upon full payment, clients receive ownership of final agreed deliverables created specifically for them (e.g., final website code, final logo files, final ad creative).
• Swami Empire retains the right to use completed work in our portfolio, case studies, and marketing materials unless otherwise agreed in writing.
• Pre-existing tools, frameworks, templates, or proprietary processes used to deliver services remain the property of Swami Empire.

5. Performance Disclaimer

While we apply proven strategies and industry best practices, digital marketing outcomes (rankings, ad performance, conversions) depend on factors beyond our control, including platform algorithm changes, market competition, and client-side execution. We do not guarantee specific rankings, revenue, or return on investment unless explicitly stated in a signed agreement with defined performance clauses.

6. Confidentiality

Both parties agree to keep confidential business information, strategies, and data shared during the engagement private, and not disclose it to third parties without written consent, except as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, Swami Empire' liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific service giving rise to the claim in the preceding three months.

8. Termination

Either party may terminate an ongoing engagement with 15 days' written notice. Fees for work completed or in progress up to the termination date remain payable.

9. Governing Law

These Terms are governed by the laws of India, with courts in Pune, Maharashtra having exclusive jurisdiction over any disputes.

10. Changes to These Terms

We may revise these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
